UK & EU Series: Risk Management for Trustees

Date
14 October 2020
Time
2:00 pm - 3:00 pm
UKEurope

In partnership with Farrer & Co, we are hosting a webinar using a case study of an UHNW family with offshore trust structures. The case study will bring out the risk factors that trustees and offshore advisors should consider when dealing with complex international clients. It will look at their situation from a range of perspectives including tax, reputation management & residential property.

The discussion will be pre-recorded with our panel, who will follow the discussion with a live Q&A for those registered. Don't miss the chance to discuss the key topics and trends of the day with one of London leading private client law firms.

The speaker line up includes: Adam Carvalho; Debbie Pennington; Tom Rudkin; and Hugh Wigzell.

Adam Carvalho - Partner, Farrer & Co, London. Adam is an experienced contentious trusts and estates lawyer. He advises on complex trust, succession and private wealth disputes, regularly tackling multi-jurisdictional issues and involved with high-profile cases. He is recognised amongst clients and peers for his pragmatic and collaborative approach.

Debbie Pennington - Partner, Private Client team, Farrer & Co, London. She advises a broad range of clients including individuals, trustees and family offices. Debbie's work regularly has an international element and her clients are based in many jurisdictions around the world.

In a fast-moving and increasingly transparent world, Debbie has expertise in advising clients on the most appropriate structures to hold assets, taking account of personal and family circumstances, risk, tax and confidentiality concerns. She routinely works with trustees in relation to high-value non-UK trusts, advising on the balance of power and control between the trustee and family members, the impact of new transparency regimes such as the common reporting standard, and tax considerations arising from the residence positions of beneficiaries and the location of trust assets. Debbie has significant expertise in advising on UK tax as it applies to non-domiciled UK resident individuals, both on personal assets and also the extensive UK rules relating to the taxation of UK resident settlers and beneficiaries of non-UK trusts. She also has considerable experience in liaising with foreign tax advisers and co-ordinating tax advice worldwide.

Hugh Wigzell - Senior Associate, Farrer & Co, London. Hugh is a residential property specialist experienced in high-value conveyancing and acting for both banks and borrowers in secured lending transactions. In particular, Hugh has extensive experience in acting on new-build acquisitions and sales and frequently represents purchasers based outside of the UK. Hugh is a senior associate in the Farrer & Co Property team.

Conveyancing is a process-driven area of the law, and Hugh works hard to ensure that his clients' interests are paramount by ensuring that the process is made as streamlined as possible through prompt and clear communication. Hugh ensures that he understands his client's objectives and tailors his advice according to his client's requirements. Hugh takes a commercial and collaborative approach to property law, and is always conscious that all parties to a transaction share an overarching common goal of completing the matter as efficiently as possible. Clients and intermediaries alike appreciate Hugh's clear communication and collaborative, calm, proactive approach to what can often be a stressful process. Hugh qualified as a solicitor in 2012.

Tom Rudkin - Senior Associate, Reputation Management and Disputes team, Farrer & Co, London. Tom advises the firm's clients on reputational and other similar risks, from mainstream media coverage to cyber security. He also has a particular focus on the sports sector, where he advises clients on regulatory and other contentious issues, and has also worked on a range of commercial (including intellectual property) disputes.

Consistent with the team's ethos, Tom's work is very diverse and he firmly believes in a holistic approach to protecting clients' reputations. He advises clients on all aspects of reputation and risk management, ranging from how they should respond to print and broadcast coverage, to online reputation management, crisis planning and cyber security issues. Key areas of law on which Tom advises include defamation, privacy, data protection, harassment, blackmail, trademark and copyright.

Tom also has a strong reputation in sports law, where he provides advice to a variety of clients, from governing bodies to individual athletes. He regularly advises the likes of British Rowing, UK Athletics, the Lawn Tennis Association and other governing bodies on a range of contentious and regulatory issues, from selection disputes to internal investigations. He also advises individual sportsmen and women on reputation management issues and disputes.

Joseph de Lacey, Associate, Farrer & Co, London. Joseph is a litigator who specialises in complex trusts and estates disputes, often for high and ultra-high net worth individuals and families. He has particular expertise in claims for breach of trust, applications for removal of trustees and protectors, Public Trustee v Cooper applications in respect of 'momentous decisions' taken by trustees, inter-family disputes in relation to the ownership of valuable antiques and artworks and claims in relation to the administration of estates, including constructive trust and proprietary estoppel claims.

Joseph has acted in a number of highly contentious family trust disputes and is therefore familiar with the delicate balance that is required between protecting the client's position and minimising damage to family harmony. Joseph also acted on one of the leading cases in relation to the role of protectors of trusts (Davidson & Anor v Seelig & Ors, [2016] EWHC 549 (Ch). Joseph was named as one of the Top 35 Private Client Lawyers Under 35 by eprivateclient in 2018.
